Terms & Conditions of Use – Numeral Only Plates

About our Website

Welcome to www.tasplates.com (Website). You are granted the right to use the Website by Plate Impressions Pty Ltd ABN 331 052 622 299 trading as ‘TasPlates’ (TasPlates).

TasPlates is appointed pursuant to the Vehicle and Traffic Act 1999 as delegate of the Registrar of Motor Vehicles in the State of Tasmania to undertake certain rights, functions and responsibilities to register motor vehicles in accordance with the Vehicles and Traffic (Driver Licensing and Vehicle Registration) Regulations 2021, in particular products and services relating to personalised number plates.

Acceptance of Numeral Only Plate Terms

Please read these terms and conditions of use (Numeral Only Plate Terms) carefully. By accessing and using the features of the Website, including the Purchase Services, you will be deemed to have read, understood and accepted these Numeral Only Plate Terms. If you do not wish to be bound by these Numeral Only Plate Terms you may not access or use the Website, or purchase Numeral Only Plates.

TasPlates reserves the right to amend these Numeral Only Plate Terms at any time without notice. Any amended terms will be effective upon publication to the Website.

Please be aware that TasPlates may, from time to time, make certain Numeral Only plates available for purchase utilising third-party websites, such as Marketplates.com. When you purchase a Numeral Only plate from a third party website like Marketplates you will be required to adhere to the policies of that website in addition to those of TasPlates, including terms of service and policies relating to privacy. TasPlates is not responsible for the operation or performance of third-party websites, and excludes any liability in relation to same.

Purchase Services

Goods and services described and featured on the Website are made available for purchase on the Website or from the TasPlates Contact Centre (1300 787 060), and in some cases via authorised third-party platforms such as Marketplates.com at the specified price, on or before any stated end date, or until otherwise removed from sale (Purchase Services). You may only make use of the Purchase Services to purchase Numeral Only Plates in accordance with these Numeral Only Plate Terms (and, as applicable, the policies and terms of an authorised third-party platform), and any applicable law, regulation, practices, codes or guidelines. You may not use the Purchase Services if you are not of legal age to form a binding contract with TasPlates (or an applicable authorised third-party website).

TasPlates may in its sole and absolute discretion make available for purchase a range of goods and services, including limited supply, numeral only number plates, typically configured with three (3) to six (6)-digit numbers (Numeral Only Plates).

Any photographs, specifications, drawings or such other information used on the Website to display the goods and services available for purchase using the Purchase Services (including Numeral Only Plates) are provided for illustrative purposes only. The actual good or service you purchase may differ from any representation of it on the Website.

By accessing the Website and Purchase Services to purchase a Numeral Only Plate you acknowledge and agree:

You are required to declare whether you wish to use or display the Numeral Only Plate.
If you initially choose to purchase a Numeral Only Plate for display purposes only, but later decide to register the Numeral Only Plate for use on a vehicle, you must complete an Application for Replacement Plates with Service Tasmania. Service Tasmania will charge you a fee.
You may transfer ownership of a Numeral Only Plate by completing the transfer documentation provided by Service Tasmania. Service Tasmania will charge you a fee.

Purchase of Numeral Only Plate

Numeral Only Plates are not available for purchase at all times, but instead offered for purchase from time-to-time. TasPlates reserves the absolute discretion to remove Numeral Only Plates from the Website (including any authorised third-party website) and from sale at any time.

When offered for purchase, a selection of Numeral Only Plates will be displayed along with an accompanying date of sale (Sales Date). The purchase price of each Numeral Only Plate may or may not be displayed when the plates are listed. If prices are not displayed you may access plate prices by contacting the TasPlates Contact Centre.

Although Numeral Only Plates listed for sale are displayed on the Website (including any authorised third-party website), purchases of Numeral Only Plates may only be made via the TasPlates Contact Centre over the phone, using a valid VISA or Mastercard

When purchasing a Numeral Only Plate you must agree to payment of the purchase price confirmed with you by TasPlates (Purchase Price).

When purchasing a Numeral Only Plate you must agree to be bound by these Numeral Only Plate Terms, any other applicable policies of TasPlates (including our Privacy Policy), any relevant terms or policies of an authorised third-party website (such as Marketplates), and any additional terms such as those required by the Payment Gateway Provider.

Following payment of the Purchase Price you will be issued with a receipt via email and the applicable plate will be marked as ‘sold’ where it is listed in real time.

Change of Mind – Refund Policy

TasPlates may, in its sole and absolute discretion, provide a refund on the purchase of any Numeral Only Plate if you have a ‘change of mind’ within 1 business day of the date of purchase. In order for TasPlates to consider your change of mind refund request you must meet the following requirements:

Contact the TasPlates Contact Centre within not longer than 1 business day of the date of purchase to lodge a refund request.
Provide any evidence of purchase required by TasPlates.

Misuse of Platform

Customers must access and use the Marketplates platform solely for the purpose of browsing, reserving, and purchasing Numeral Only Plates in accordance with the Numeral Only Plate Terms and all applicable terms, conditions and policies of Marketplates.
Any misuse of the Marketplates platform is strictly prohibited. For the avoidance of doubt, “misuse” includes, but is not limited to:
a. the use of bots, automated scripts, software tools, or any other non-human process which may be used to make, accelerate, or duplicate reservations;
b. attempting to reserve multiple plates in a manner intended to circumvent the platform’s processes or restrictions; or
c. any conduct that interferes with, disrupts, or otherwise compromises the fair and proper functioning of the Marketplates reservation system.
If we reasonably determine that a Numeral Only plate reservation has been made in contravention of these Numeral Only Plate Terms (and all applicable terms, conditions and policies of Marketplates) we may, in our sole discretion and without prior notice:
a. cancel the reservation immediately; and
b. return the affected Numeral Only plate for purchase by other customers.
We reserve the right to implement any additional technical, administrative, or legal measures deemed necessary to protect the integrity, security, and fairness of the platform and Numeral-Only plate purchase process.

Delivery

TasPlates engages third party delivery partners to complete delivery of your purchased Numeral Only Plate (Delivery Partners). You acknowledge and agree that TasPlates does not complete delivery of purchased Numeral Only Plates and instead merely facilitates provision of delivery services by our Delivery Partners.

Fraud Prevention

Within fifteen (15) days of the date you purchase a Numeral Only Plate a representative of TasPlates will contact you to confirm you have received your Numeral Only Plate. This contact supports TasPlates’ due diligence in fraud prevention.

Returns

In the event you need to return your purchased Numeral Only Plate you may do so by returning it:

to any Service Tasmania location; or
to TasPlates via the post: TasPlates at PO Box 1128, Hobart, Tasmania, 7001, Australia. In such case you may be charged a fee for postage and shipping, for which TasPlates is not liable.

Replacement of damaged, lost, destroyed or stolen Numeral Only Plate

You may replace a lost, damaged, destroyed or stolen Numeral Only Plate at your own expense by contacting the TasPlates Contact Centre.

Your Information

To access and use the Purchase Services you will be required to provide information about yourself. That information may include:

your full name
your date of birth
an email address
Tasmanian drivers licence number
a mailing address
a telephone number
details of any additional owner, including full name and address
registration details, make and year of manufacture of vehicle
information required in relation to a Gift Voucher
payment details

Your information will be collected when you complete purchase of a Numeral Only Plate from the TasPlates Contact Centre, if you use the Purchase Services and/or if you set up a TasPlates account (or Marketplates account) and become a registered customer (Customer).

Customers have the option to create an account on Marketplates.com for ease of browsing and submitting offers. While account creation is optional, if you do wish to reserve a Numeral Only plate listed on Marketplates and proceed to purchase you will first need to set up a Marketplates account. TasPlates does not collect or store Marketplates account information, and users are subject to Marketplates’ own privacy policy and terms of use in relation to Marketplates accounts and interactions.

Your obligations as a Customer

As a Customer of TasPlates purchasing a Numeral Only Plate you agree that you will:

not attempt to resell any Numeral Only Plate you purchase within one (1) month of the date of purchase.
provide all reasonable assistance to TasPlates in its efforts to prevent any instances of fraud in relation to Numeral Only Plates.
only use the Purchase Services for purposes permitted by TasPlates.
at all times act in accordance with these Numeral Only Plate Terms, and any additional terms and conditions published by TasPlates that relate to your use of the Website and Purchase Services.
at all times act in accordance with applicable laws, regulations, codes, practices or guidelines.
only provide to TasPlates information that is true, accurate and current.
not allow a person other than yourself to access the Purchase Services and/or use your TasPlates Customer account. For the avoidance of doubt, your TasPlates Customer account is non-transferable.
immediately notify TasPlates if you become aware of any unauthorised use of your TasPlates Customer Account, or any other breach of security.
not use the Purchase Services, Website or your TasPlates Customer account for any illegal and/or unauthorised uses, including without limitation any automated uses. Appropriate legal action will be taken by TasPlates for any illegal or unauthorised uses.
not upload or attempt to upload any material that contains viruses or any other harmful programs which have the effect or may have the effect of interfering with or disrupting the Website and Purchase Services.
not engage in any conduct which has the effect or may have the effect of interfering with and/or harming the intellectual property and proprietary rights of TasPlates.
at all times respect TasPlates discretion to publish, apply, amend or remove commercial advertisements, affiliate links, and other forms of solicitation without notice to you.

Consumer Guarantees

TasPlates’ Change of Mind – Refund Policy applies in addition to and does not affect your rights under the Australian Consumer Law (ACL). Goods and services purchased from TasPlates (including Numeral Only Plates) come with guarantees that cannot be excluded under the ACL.

The ACL protects consumers by giving them certain guaranteed rights when they buy goods and services. For example, the ACL requires that goods must be free of defects and do what they are meant to do. Services must be carried out with care and skill. These rights automatically apply whenever goods or services are supplied to a consumer. They are called the ‘Consumer Guarantees’.

The Consumer Guarantees entitle consumers to a replacement or refund in the event for a major failure, or have the goods repaired or replaced if they fail to be of “acceptable quality” but the failure does not amount to a major failure.

For goods, a major failure inconsistent with the Consumer Guarantees will include (without limitation) circumstances where you would not have purchased the product if you had known about the problem or problems; the product is significantly different from the description, sample or demonstration model you were shown; the product is substantially unfit for its normal purpose; or the product is unsafe.

The Consumer Guarantees have no defined time limit but will generally apply for an amount of time that is reasonable to expect given factors including the cost and quality of the product.

In order to make a claim pursuant to the Consumer Guarantees TasPlates requires you to:

provide proof of purchase (such as your receipt), including the applicable Purchase Price;
a description of the products purchased;
provide written notice to TasPlates at PO Box 1128, Hobart, Tasmania, 7001, Australia or by email at info@tasplates.com.

Neither the Consumer Guarantees or TasPlates’ Change of Mind – Refund Policy will apply if a product purchased from TasPlates has been damaged or defaced through misuse, abnormal service or handling, or has been altered or modified in design or construction.

Intellectual Property Rights

The Website, Purchase Services and all products made available for purchase by TasPlates, including Numeral Only Plates, are offered subject to intellectual property rights, including copyright. The Website and its component parts are protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated or stated all proprietary and intellectual property rights (including copyright, trademarks and patents) on the Website (including any subdomains) and in Website content (such as graphics, logos, button icons, video images, audio clips, forms, process and software) (Content) is wholly owned and/or controlled by TasPlates.

TasPlates retains all rights, title and interest in and to the Website and Content. Your use of the Website and Purchase Services does not in any way grant to you any rights to:

the business names, trading names, domain names, trade marks (registered or otherwise), industrial designs, patents, registered designs or copyright of TasPlates; or
use or exploit a business name, trading name, domain name, trade mark or industrial design (whether registered or otherwise) of TasPlates; or
use, reverse engineer, modify or exploit a system or process that is the subject of a patent (or patent pending), registered design or copyright (or an adaptation or modification of such a system or process) of TasPlates.

You may view the Website and Content for personal, non-commercial use only and, subject to the Copyright Act 1968 (Cth) (and similar legislation), you may not in any form or by any means reproduce, modify, distribute, store, transmit, publish or display within another website or create derivative works from any part of the Website or commercialise any information obtained from any part of the Website without the prior written consent of TasPlates, in the case of third party material, from the owner of the copyright in that material.

You may not modify or copy the layout or appearance of the Website, nor any computer software or code contained in the Website, nor may you decompile or disassemble, reverse engineer or otherwise attempt to discover or access any source code related to the Website.

Nothing contained on the Website is to be interpreted as a recommendation to use any information on the Website in a manner which infringes the intellectual property rights of any person. TasPlates makes no representations or warranties that your use of the information on the Website will not infringe such intellectual property rights.

If you correspond or otherwise communicate with TasPlates you automatically grant to TasPlates an irrevocable, perpetual, non-exclusive, royalty-free, world-wide licence to use, copy, display and distribute the content of your communication and to prepare derivative works of the content or incorporate the content into other works in order to publish and promote such content. This may include, but is not limited to, publishing testimonials on this website and developing your ideas and suggestions for improved products.

General Disclaimer

You acknowledge and agree that:

TasPlates does not make any guarantees, warranties, representations or conditions whatsoever regarding the Website, Purchase Services and products for purchase from TasPlates (including Numeral Only Plates) other than as expressly stipulated, including pursuant to these Numeral Only Plate Terms.
TasPlates takes all reasonable steps to ensure its products and the Content of the Website are accurately depicted, however pursuant to these Numeral Only Plate Terms you acknowledge and agree that sizing, colours and packaging may differ from what is displayed. TasPlates does not accept responsibility or liability for any inadvertent error, omission, or defect. The products (including Numeral Only Plates) and Content of the Website are displayed for general information purposes only.
any communications, comments, stories or images you send to us (via the Website, email, socials or otherwise) are provided on a non-commercial basis. You agree that TasPlates may, in its absolute discretion, reproduce, publish, or otherwise use the contents of such communications (or edited versions of such communications), including but not limited to your name, an image, or content, in any way, in any media, including on TasPlates’ social media accounts, for any purpose, and without remuneration, subject to applicable regulatory and legislative obligations.
all terms, guarantees, warranties, representations or conditions which are not expressly stated in these Numeral Only Plate Terms are excluded.
TasPlates will not be liable for any special, indirect or consequential loss or damage, loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Purchase Services or these Numeral Only Plate Terms (including as a result of not being able to use the Purchase Services or the late supply of the Purchase Services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.
use of the Website, Purchase Services, purchase of any products (including Numeral Only Plates) and delivery of any goods purchases via our Delivery Partners is at your own risk. Everything on the Website is provided to you on an "as is" and "as available" basis, without warranty or condition of any kind. TasPlates affiliates, directors, officers, employees, agents, contributors, third party content providers or licensors of TasPlates (including third parties such as the Delivery Partners) do not make any express or implied representation or warranty about the Website, Purchase Services, purchase of any products (including Numeral Only Plates) and delivery of any goods purchases via our Delivery Partners.
TasPlates will not be responsible or liable to you for:
1. any failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records.
2. the accuracy, suitability or currency of any information on the Website, the Purchase Service, any of its Content, or products (including third party material and advertisements on the Website).
3. costs incurred by you as a result of your use of the Website and Purchase Services.
4. for the condition or content of third party linked sites not under the control of TasPlates. Access to these third party websites is at your own risk;
5. your entry or participation in any competition or promotion run by TasPlates.
6. any failure to complete a transaction, or any loss arising from an e-commerce transacted on the Website.
7. any defamatory, threatening, offensive or unlawful conduct of third parties or publication of any materials relating to or constituting such conduct.

Limitation of Liability

You acknowledge and agree that:

TasPlates' total liability arising from out of or in connection with the Purchase Services, your purchase of a Numeral Only Plate, and these Numeral Only Plate Terms, however arising, including under contract, tort (not limited to negligence), in equity, under statute or otherwise, will not exceed the Purchase Price paid by you (including, as the case may be, the value of resupply to you).
TasPlates, its affiliates, employees, agents, contributors, third party content providers and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.
TasPlates is not responsible or liable in any manner for any content (including the Content and Third Party Content) posted on the Website, or related social media sites, or in connection with the Purchase Services, whether posted or caused by users of the Website by third parties or by any of the Purchase Services offered by TasPlates.
TasPlates engages the services of third party Delivery Partners and it will not be liable to you for any losses, costs or damages (including any special, indirect or consequential loss or damage, loss of profit or opportunity, or damage to goodwill) arising out of or in connection with delivery of goods you purchase from TasPlates.
TasPlates will not assume any liability nor take any responsibility for any technical malfunction, error or omissions, interruption, deletion, delay in operation or transmission, communications line failure, virus, bug, tampering, theft or destruction or unauthorised access to or alteration of the Website, or any injury or damage to any persons computer, related to the participation or downloading of any material from the Website.

Terminate Purchase or recall order

TasPlates may at any time terminate or recall your order for a Numeral Only Plate if:

you breach any provision of these Numeral Only Plate Terms.
TasPlates is required to do so by law.
a Delivery Partner fulfilling delivery of your order terminates its engagement with TasPlates.
provision of your order by TasPlates is, in the opinion of TasPlates, no longer commercially viable.

You acknowledge and agree the Tasmanian government may also recall any Plate (including a Numeral Only Plate) purchased from TasPlates at any time, whether or not issued and paid for.

Indemnity

You agree to indemnify TasPlates, and its related corporations, affiliates, officers, directors, employees, agents, licensors and contractors from and against all actions, claims, losses, liabilities, expenses, damages and costs (including legal expenses on a full indemnity basis) it may incur in connection with your use of the Website, Content, and Purchase Services, including from your conduct in connection with the Website or other users, any violation of these Numeral Only Plate Terms, any law, and any rights of any third party (including intellectual property rights).

Governing Law and Jurisdiction

These Numeral Only Plate Terms are governed by and interpreted in accordance with the laws of Tasmania, Australia and you irrevocably submit to the non-exclusive jurisdiction of the Courts of Tasmania, Australia. TasPlates makes no representations that the Website and Contents comply with the laws of any country other than Australia.

Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to these Numeral Only Plate Terms shall be governed, interpreted and construed by, under and pursuant to the laws of Tasmania, Australia.
