Terms and Conditions – Plate Tales
1. Definitions
For the purpose of these Terms and Conditions:
Owner means the lawful holder or purchaser of a Tasmanian number plate (“Plate”), whether or not the Plate is currently affixed to a vehicle, and/or the lawful owner of any vehicle shown in the Content, who has provided a photograph or video of such Plate and/or vehicle and consents to TasPlates’ use of that Content.
Content means any photograph(s) and/or video(s) supplied by the Owner that display the Plate and/or vehicle.
2. Purpose of Content
TasPlates may collect and store the Content as part of its “TasPlates library” for possible use, at TasPlates’ sole discretion, in marketing and advertising tactics, executions, productions, materials, and collateral.
3. Licence
Pursuant to the terms of this Agreement, the Owner grants TasPlates a non‑exclusive, fully paid, royalty‑free, transferable, sublicensable, worldwide licence to use any Content supplied by the Owner that displays the Plate and/or vehicle.
4. No Payment
The parties mutually and severally agree that the Owner will not receive any form of payment or monetary consideration in relation to the Content, including in relation to its use by TasPlates.
5. Consent
The Owner irrevocably consents, acknowledges, and agrees to the following:
- To provide information about themselves personally and in relation to the Plate, warranting that all such information provided is true and correct.
- That TasPlates may use the Owner’s name and the Content in any medium or manner whatsoever, in perpetuity.
- That the Owner will not receive any payment or financial consideration in relation to any matters contemplated by this Agreement.
- Not to behave in any manner (whether by act or omission), or make any statements or representations, likely to adversely affect the reputation, goodwill, products, or services of TasPlates.
- Not to make any public statement or representation in relation to TasPlates (including its reputation, goodwill, products, or services) without the prior written consent of TasPlates, which may be given or withheld at TasPlates’ sole and absolute discretion.
6. Acknowledgement
The Owner (or the parent or guardian of the Owner if the Owner is under 18 years of age) acknowledges that:
- They have been provided with a copy of this Agreement and have been afforded the opportunity to read, discuss, understand, and seek independent advice as necessary.
- They are over 18 years of age, or they are the parent or guardian of the Owner and over 18 years of age.
- They are the registered owner of the Plate, or the parent or guardian of the registered owner of the Plate.
- The vehicle to which the Plate is affixed has not been illegally modified in any way.
- No payment whatsoever will be made to them by TasPlates.
- Unless expressly stated otherwise, their image or likeness may appear in the Content collected and stored by TasPlates, and TasPlates may, at its sole discretion, use the Content in marketing, promotional, and advertising campaigns, including (without limitation) on the TasPlates website (www.tasplates.com), across social media channels, EDMs, and printed collateral, for an indefinite period.
- They have obtained all necessary permissions from any other person who:
- Appears in the Content; or
- Created or produced the Content (for example, a photographer), allowing TasPlates to use the Content without payment or claim of any right, including intellectual property or proprietary rights.
- Once the Content is published or made publicly available, TasPlates has no control, liability, or responsibility for any subsequent use of such materials.
- If the Owner is under 18 years of age, the parent or guardian grants permission for TasPlates (and any third‑party production partner) to use the Content in marketing, promotional, and advertising campaigns for an indefinite period.
- TasPlates will handle personal information in accordance with the Privacy Act 1988 (Cth) and TasPlates’ Privacy Policy and will take reasonable steps to protect personal information in its possession, noting it cannot control third‑party reuse of publicly shared content.
- The Owner retains ownership of all intellectual property rights in the Content and grants TasPlates a non‑exclusive, royalty‑free, worldwide licence to use, reproduce, publish, display, adapt, and share the Content for marketing, promotional, and communications purposes.
- To the extent that any rights vest in the Owner under this Agreement, the Owner relinquishes all such rights and agrees that TasPlates will possess and retain those rights.
- The parties acknowledge that their relationship is that of independent contractors and not employer and employee, principal and agent, joint venturers, or partners.
- This Agreement is governed by the laws of Tasmania and the Commonwealth of Australia, and each party irrevocably submits to the non‑exclusive jurisdiction of the courts of Tasmania and the Commonwealth of Australia.
- This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, representations, or understandings in relation to its subject matter.
- This Agreement may only be varied or amended by written agreement of the parties.
7. TasPlates Library
The “TasPlates library” is a collection of photographs and videos stored and used by TasPlates, at its sole discretion, for purposes including (without limitation) publications, presentations, websites, posters, newsletters, marketing, advertising, promotions, and social media. Selected images may be shared with third parties, including media organisations, for similar purposes. All intellectual property rights associated with photographs and videos stored in the TasPlates library vest solely and perpetually in TasPlates.
